Once more Ms West has successfully used the DMCA (Digital Millennium Copyright Act) to stop you reading or listening to the truth about her and the activities of her cult in Montana.  Put simply if the website is hosted in the USA or the registrar for the domain name is in the USA then anyone can complain about any website, even if the complaint is totally fictitious, and the site owner has the option of removing the content or agrees to accept a lawsuit!

In brief Ms West’s latest complaint comes in three parts.

1.       She alleges that I am using a photo on every page of the site that belongs to her.  This is an outright lie (what else do you expect?) because when she made a previous complaint about using her photos I removed them all from the site and used, instead a photo my wife took that West does not own copyright of.  Ms West goes on to allege that all students / employees sign a waiver and that all photos belong to her.  My wife signed no such waiver.  Indeed my wife was asked by West to take some photos of her because she had no good photos.  My wife did this for free but never signed over the copyright.

I theory we could complain about the photos that West is using that belong to my wife however in practice this would be difficult because West hosts her sites in Australia well beyond the reach of the DMCA.  In this way she CAN use other people’s copyright material and make outrageous claims about herself when all the evidence points to the fact that she is the opposite of what she says she is.  For an example of this just go to this recent news article where you will read about Ms West’s use of a photograph of local private home, against the owners wishes, where she represents it as part of her nonexistent spa complex!

2.       Ms West alleges that I am using on my site documents that were ‘stolen’ from her office.  These documents were not stolen.  These documents, channelling’s  from Ms West’s invisible friends (the voices in her head!), contain an admission of guilt by West, in respect of the alleged assault against Dr Patricia MD, were acquired by an ex employee.  This employee did NOT sign a confidentiality agreement and thought that the documents were of public interest because they allegedly contained crucial information about a lawsuit where West maintains her innocence in public and in defending the case against her and admits being guilty in private!

3.       Ms West alleges copyright over a recording I made of a conversation that we had back in 2003.  During that conversation Ms West candidly admits the breach of contract against me but says she is not paying and challenges me to do something about it saying, “she’ll get down and dirty” if I issue a lawsuit against her!  She also goes on to basically admit that the whole Surya Ma / school stuff is just a way of earning a good living and that basically she disposes of people like Kleenex once their usefulness is over!

To be honest I did consider accepting a lawsuit on the above three issues as there seems to be a lot of merit in discussing in court a) the ownership of the photograph – easy to prove her a liar.  And b) I really relished the opportunity to discuss in court what the voices in her head are saying to her about the alleged beating she meted out to Dr Patricia MD.  From memory the voices in her head acknowledged that while severe the beating was administered from highest good and at all times with grace?

The victim alleges that she was beaten on the head with the heel of a shoe until her skull bled.  The victim also alleges that she had a loaded gun held against her head by West who threatened to blow her brains out saying she, West, had the spiritual authority to do so! 

And finally if we went to court over the ownership of the conversation I recorded could we combine that with my breach of contract lawsuit.  There is nothing better than getting an admission of guilt.  To have that admission of guilt played out in court renders the whole process a foregone conclusion but is Ms West offering to settle?  No way getting down and dirty has worked for her in the past and she is a creature of habit eh?

The other problem with going to court to argue out these issues, as appealing as that might be, is that Ms West, if rumours are to be believed, has just lost her latest lawyer?  From memory she has had more lawyers than I have had hot dinners.  It helps to pay them although the silver lining for Ms West is that, once more, she has delayed her appearance in court to face the charges levelled against her by Dr Patricia MD.

In summary West has used the DMCA, designed by well meaning lawyers to protect copyright infringements on the web, to censor and remove sensitive information that she desperately does not want you to see or hear!  Of course this ability of hers to deprive the public of information can only work so long as my domain names are registered in and the sites are hosted in the USA.

That is in the process of changing!  All of this information will be back up on the web shortly!  You cannot surpress the truth for long.
